This paper reflects on the issue of European cooperation regarding the fields of Justice and Home Affairs (JHA), especially the Portuguese experience. It starts by tracing the constitutional evolution of this field, the main steps in this evolution being the Treaty of the European Union and the Treaty of Amsterdam. It then focuses on the Portuguese experience, especially regarding the Portuguese participation in the implementation of the Schengen acquis – one of the most important aspects of the Portuguese experience of cooperation on JHA matters –, and consequent obligations, effects and implementation in the Portuguese State. Lastly, it ponders about the obligations of the Portuguese State resulting from the remaining JHA acquis and the monitoring and evaluation of its performance.
